In this Policy, unless specified otherwise, words and phrases shall have the same meanings as specified in our Terms of Use and Sale which can be viewed in the Legal section of this app.
CLAIRE AND OSCAR PRODUCTIONS LTD, a company registered in Scotland under SC744576, whose registered address is 4-6 Polwarth Gardens, Edinburgh, Scotland, EH11 1LW, understands that your privacy is important to you and that you care about how your personal data is used and shared online. We respect and value the privacy of Users and will only collect and use personal data in ways that are described here, and in a manner that is consistent with Our obligations and your rights under the law.
Please read this Privacy Policy carefully and ensure that you understand it. You will be required to read and accept this Privacy Policy when signing up for an Account. If you do not accept and agree with this Privacy Policy, you must stop using Our App immediately.
If you are a child please read our Information for children, at the end of this Policy, this is a child friendly version of this Privacy Policy.

This Privacy Policy applies only to our use of data gathered by Us in your use of Our App.

As a data subject, you have the following rights under the Data Protection Legislation, which this Policy and Our use of personal data have been designed to uphold:
- The right to be informed about Our collection and use of personal data;
- The right of access to the personal data We hold about you (see section 13);
- The right to rectification if any personal data is inaccurate or incomplete;
- The right to be forgotten – the right to ask Us to delete any personal data We hold about you;
- The right to restrict (i.e. prevent) the processing of personal data;
- The right to data portability;
- The right to object to Us using personal data for particular purposes; and
- Rights with respect to automated decision making and profiling.
If you have any cause for complaint, please contact Us using the details in section 16. You also have the right to lodge a complaint with the UK's Information Commissioner's Office (https://ico.org.uk/).
5. WHAT DATA DO WE COLLECT?
We may collect some or all of the following personal and non-personal data:
- name;
- email addresses;
- IP address;
- device type and iOS version;
- a list of screens you visit within Our App;
- McMuso conversation queries (the text you send to our AI music companion);
- App Store subscription status, transaction identifier, and renewal/expiry dates (we do not collect or store credit/debit card numbers, your Apple ID password, or any other payment details — these are handled directly by Apple; see Section 8).
We will never explicitly request any personal data pertaining to children.
6. HOW DO WE USE YOUR DATA?
All personal data is processed and stored securely, for no longer than is necessary. We will comply with Our obligations under the Data Protection Legislation at all times.
Our use of personal data will always have a lawful basis. We may use personal data for:
- Providing and managing your Account;
- Providing and managing your access to Our App;
- Personalising and tailoring your experience;
- Supplying Our products and services to you;
- Verifying your Musoplay+ subscription or Memory Week Pass status with Apple;
- Providing customer support for billing and subscription queries;
- Replying to emails from you;
- Supplying you with emails that you have opted into;
- Analysing your use of Our App to improve it.
You have the right to withdraw your consent to Us using your personal data at any time, and to request that We delete it.
Data retention periods:
- Account holder data – retained until Account is deleted;
- Marketing subscriber data – kept until you Unsubscribe;
- Subscription status (active/cancelled, start/end dates) – retained for as long as your Account exists. Apple retains payment records (card details, billing address, transaction history) in accordance with their own retention policies and applicable financial record-keeping requirements.
7. HOW AND WHERE DO WE STORE YOUR DATA?
We store some data within the UK and European Economic Area (EEA), fully protected under UK and EU GDPR.
Some data is stored outside the UK and EEA with additional safeguards in place.
The database (game scores, usernames) is on Firestore Eur3 (various European locations).
Security measures include limiting access to authorised personnel and maintaining procedures for dealing with data breaches.
8. DO WE SHARE YOUR DATA?
We may share data with companies in Our group for administrative purposes, and may contract with third parties (payment processing, marketing).
Third-party data processors include:
- Google Inc. / Firebase for hosting, analytics, authentication, and storage;
- Anthropic PBC for AI-powered features (McMuso). Conversation text is sent to Anthropic's servers for processing. Anthropic's privacy policy applies to this processing;
- Apple Inc. for payment processing through the App Store. When you purchase a Musoplay+ subscription or Memory Week Pass, the transaction is handled entirely by Apple through your iOS device's built-in In-App Purchase flow. Apple collects and processes your payment information using the payment method linked to your Apple ID. We never receive your credit/debit card numbers, your Apple ID password, or your billing address. Apple provides Us only with a transaction identifier and confirmation of your subscription or pass status. Apple uses your payment data for payment processing, fraud prevention, and compliance with financial regulations. Apple, not Us, sends subscription-related emails such as receipts, renewal reminders, and price-change notices. You can manage all subscription preferences in Settings > Apple ID > Subscriptions on your device. For more information see Apple's Privacy Policy at https://www.apple.com/legal/privacy/.
We may be legally required to share data in certain circumstances.
9. McMUSO AI MUSIC COMPANION
McMuso is an AI-powered feature that lets you ask questions about music. When you use McMuso, the text of your conversation is sent to a cloud function hosted on Google Cloud, which forwards it to Anthropic (the AI provider) for processing.
We log McMuso queries in our Firestore database for service monitoring and improvement. These logs contain the conversation text and a random session identifier. They do not contain your name, email, or account details.
Anthropic (our AI provider) does not use API inputs to train its AI models. No personal information is included in McMuso requests.
McMuso conversations are not stored permanently on your device and are cleared when you close the chat. We do not use your McMuso conversations for advertising or share them with any party other than Anthropic for the purpose of generating responses.
The daily music quiz feature within McMuso sends quiz requests to the same AI service. Quiz interactions are treated identically to regular McMuso conversations.
10. SUBSCRIPTIONS AND PAYMENTS
Musoplay+ is an optional auto-renewing subscription that unlocks unlimited McMuso conversations. The Memory Week Pass is an optional one-time purchase that unlocks Musoplay Memory for seven days. All payments are processed by Apple through the App Store.
We do not collect, store, or have access to your payment card details, bank information, or Apple ID password. Apple handles all payment processing and provides Us only with a transaction identifier and confirmation of your subscription or pass status.

11. WHAT HAPPENS IF OUR BUSINESS CHANGES HANDS?
Any personal data you have provided will, where relevant, be transferred along with the business. The new owner will be permitted to use data only for the same purposes.

We aim to give you strong controls on Our use of your data for direct marketing purposes, including the ability to opt-out.

14. USERS UNDER 18
Musoplay is intended for adult and teenage music learners. You must be 13 or older to create an Account. The age of digital consent in the United Kingdom is 13 (Data Protection Act 2018, section 9), and Musoplay accepts that anyone aged 13 or older can consent to the processing of their personal data themselves. Accounts cannot be created by Users under 13. We recognise that Musoplay is visually approachable and may be of interest to younger Users; where We know or reasonably believe a User is under 18, We apply the additional safeguards described in Schedule 1.
We do not engage in marketing to children, nor share, sell, or profile children's data. Where a User is under 18, We will also respond to requests from a parent or guardian to exercise data protection rights on behalf of that User.
15. ON-DEVICE STORAGE
As a native iOS app, Musoplay does not use browser cookies. Instead, Our App stores small amounts of data locally on your device using iOS storage mechanisms such as UserDefaults, Keychain, and local database files. This storage is used only by Us to facilitate and improve your experience.
Our App may also store data placed by third-party SDKs (for example, Firebase authentication tokens and analytics identifiers).
First party on-device storage includes:
- musoplay-user-id: Stores User ID
- musoplay-user-email: Stores user email
- gameCompletedToday: daily completion tracking
- lastGameScore: most recent score
- lastGameHearts: performance metrics
- pendingScores: scores that failed to sync
- mainGameRefreshes: refresh tracking
- forceCalendarRefresh: UI calendar updates
Third party on-device storage includes:
- Firebase authentication tokens and refresh tokens
- Firestore offline persistence cache
- Google OAuth tokens (Keychain)
Our App uses Firebase Analytics. You can limit ad tracking and reset your advertising identifier in iOS Settings > Privacy & Security > Tracking.

17. CHANGES TO OUR PRIVACY POLICY
We may change this Privacy Policy from time to time. For significant changes, you will be required to accept the updated terms.
SCHEDULE 1: INFORMATION FOR USERS UNDER 18
Musoplay is intended for adult and teenage music learners. This Schedule is a supplementary, child-friendly explanation for any User under 18 whose parent or guardian has created an Account for them. If you are an adult User, the main Privacy Policy above is the authoritative version.
We are Claire and Oscar Productions Ltd. We own an app called Musoplay which provides a fun, interactive, daily music game.
To allow you access to certain parts of the App we need to collect, use, share and store certain information.
What is Personal Data?
Personal data is information about an individual such as your name, age and where you live.
What Personal Data Do We Collect?
We try to collect as little personal data as possible. You may not create an account if you are under 13 years of age. If you are under 13, your parent or guardian must create the Account for you. If under 18, you must not include your name, address, age, date of birth or school name in your account information.
How do we keep it safe?
- All data is transferred securely with regular security checks;
- We use password protections;
- Only specific team members can access your data;
- We regularly back-up data;
- Where possible we anonymise data;
- Written agreements with third parties to keep data safe.
Protections to keep you safe:
- You cannot upload videos or images;
- User-to-user communication is disabled.
How Long Do We Keep Your Data?
We only keep your data for as long as we need to. If your account is deleted, all information is also deleted.
Cookies and Analytics
Our App uses cookies and local storage — small files downloaded to your device. A pop-up will ask for your consent. Analytics help us understand how the App is used and are safe.

Terms of Use & Sale
BACKGROUND
These Terms of Use set out the terms under which a User may use this Musoplay application ("Our App"). Please read these Terms carefully. If you do not agree to comply with and be bound by these Terms, you must stop using Our App immediately.

Our App is owned and operated by Us.
2A. INTENDED AUDIENCE
Musoplay is a daily music game designed for adult and teenage music learners — particularly lapsed musicians and people who want a fun, low-pressure way to keep their musical ear sharp. It is not targeted at children and is not submitted to Apple's Kids Category or Google Play's Designed for Families program.
You must be 13 or older to create an Account. The age of digital consent in the United Kingdom is 13 (Data Protection Act 2018, section 9), and Musoplay accepts that anyone aged 13 or older can consent to use the App and its features themselves. Accounts cannot be created by Users under 13. We recognise that Musoplay is visually approachable and may be of interest to younger Users; we apply additional safeguards for any User We know or reasonably believe to be under 18. Further detail is set out in Clause 4 (Accounts) and in Our Privacy Policy.
3. ACCESS TO OUR APP
Access to Our App is free of charge. Certain premium features (such as unlimited McMuso conversations) require a paid subscription (see Clause 20).
It is a User's responsibility to make any necessary arrangements to access Our App.
4. ACCOUNTS
Certain parts of Our App may require an Account.
Musoplay is intended for adult and teenage music learners. You must be 13 or older to create an Account. We recommend that Users choose a memorable display name (a nickname, combination of words, or musical interest) rather than personal details such as full names, birthdates, or school names — display names may be visible to other Users on leaderboards and shared content.
Account information must be accurate and complete. A strong password is recommended.
You must not use anyone else's Account without permission.
If you wish to close your Account, you may do so at any time. Closing will result in removal of your information.
5. INTELLECTUAL PROPERTY RIGHTS
All Content on Our App (except User Content) belongs to or has been licensed by Us and is protected by applicable intellectual property laws.
A User may:
- Access, view and use Our App;
- Save pages for later and/or offline viewing.
Our status as owner and author must always be acknowledged. Nothing in these Terms limits fair dealing provisions of the Copyrights, Designs and Patents Act 1988.
6. USER CONTENT
User Content includes usernames and melodies or tunes created using Our App's composition tools ("User Melodies"). Users cannot upload photographs or other images to Our App. An Account is required to submit User Content.
You are solely responsible for your User Content, which must comply with Our Acceptable Usage Policy (Clause 13).
You retain ownership of your User Content but grant Us a worldwide licence to use, store, publish, transmit, adapt, and sub-licence it for operating and promoting Our App.
We may reject, reclassify, or remove any User Content that violates Our policies.
6A. USER-CREATED MELODIES AND TUNES
Our App allows Users to create melodies and tunes ("User Melodies") using Our composition tools. This Clause 6A sets out the terms relating to the ownership, use, and licensing of User Melodies.
Ownership. You retain ownership of any User Melodies that You create using Our App. We do not claim ownership of Your User Melodies.
Licence Grant. By creating, saving, or sharing a User Melody through Our App, You grant Us a non-exclusive, worldwide, royalty-free, perpetual licence to use, display, reproduce, and distribute that User Melody within Our App and associated services. This includes, but is not limited to, featuring Your User Melody as part of Our daily game content, sharing it with other Users, and using it for promotional purposes related to Our App.
No Payment. You acknowledge and agree that no payment, royalty, or other compensation will be due to You for any use of Your User Melodies by Us under the licence granted above. This applies whether or not Your User Melody is selected for use as part of Our daily game content or featured in any other way within Our App.
Deletion. You may delete Your User Melodies from Your personal collection at any time. However, copies of User Melodies that have been shared with other Users, used as part of Our daily game content, or otherwise distributed through Our App may continue to exist and remain accessible even after You delete the original from Your collection.
Representations. By creating and sharing a User Melody, You represent and warrant that: (a) the User Melody is Your own original creation; (b) it does not infringe the intellectual property rights or any other rights of any third party; and (c) You have the right to grant the licence set out above.
7. NO SCRAPING, TEXT OR DATA MINING
You may not undertake any form of web scraping or data mining on Our App. You may not use any part of Our App for developing or training AI models or systems.
8. LINKS TO OUR APP
Users may not link to any page other than the homepage without Our express written permission.
You may not link to Our App from any site containing material that is sexually explicit, obscene, offensive, hateful, violent, unlawful, discriminatory, threatening, deceptive, or that infringes intellectual property rights.
9. LINKS TO OTHER SITES
Links to other sites may be included on Our App. Unless expressly stated, these are not under Our control and We accept no responsibility for third-party content.
10. DISCLAIMERS
Nothing on Our App constitutes advice. We provide no guarantee that using Our App will improve a User's ability to read music or play an instrument.
Insofar as permitted by law, We make no representation or warranty that Our App will meet your requirements, be compatible with all software and hardware, or be secure.
11. OUR LIABILITY
To the fullest extent permissible by law, We accept no liability for any loss or damage arising from use of Our App.
Our App is intended for non-commercial use only.
Nothing in these Terms excludes liability for fraud, death or personal injury from negligence, or other forms of liability that cannot be excluded by law.
12. VIRUSES, MALWARE AND SECURITY
We exercise all reasonable skill and care to ensure Our App is secure.
You must not deliberately introduce viruses or malware, or attempt to gain unauthorised access. Breaching these provisions may constitute a criminal offence under the Computer Misuse Act 1990.
13. ACCEPTABLE USAGE POLICY
You may only use Our App lawfully. You must not use it for unlawful or fraudulent purposes, to transmit malware, or to harm any person.
When submitting User Content, you must not submit anything that:
- is sexually explicit, obscene, offensive, hateful, or inflammatory;
- promotes violence or unlawful activity;
- discriminates against any person, group, race, sex, religion, nationality, disability, sexual orientation, or age;
- is intended to threaten, harass, or embarrass another person;
- is calculated to deceive;
- infringes another person's privacy or intellectual property rights;
- misleadingly impersonates any person;
- implies affiliation with Us where none exists; or
- is in breach of any legal duty owed to a third party.
We may suspend or terminate your access if you breach these provisions.
14. PRIVACY AND COOKIES
Use of Our App is also governed by Our Privacy Policy, available from the Privacy Policy tab.
15. CHANGES TO THESE TERMS
We may alter these Terms at any time. Changes become binding upon your first use of Our App after implementation.

If We have your contact details, We may send you important notices by email relating to service changes, Terms changes, and Account changes.
We will never send marketing emails without your express consent. You may opt out at any time.

We may transfer Our obligations and rights to a third party. Your rights will not be affected.
You may not transfer your obligations and rights without Our express written permission.
If any provision is found unlawful or unenforceable, it shall be severed and the remainder shall remain valid.
19. McMUSO AI MUSIC COMPANION
McMuso is an AI-powered feature within Our App that provides information and answers questions about music. McMuso is powered by a third-party AI service (Anthropic).
McMuso is provided for general informational and educational purposes only. It does not constitute professional music tuition, medical advice, or any other form of professional advice.
AI-generated responses may occasionally contain inaccuracies. We make no warranty as to the accuracy, completeness, or reliability of any response generated by McMuso.
You must not use McMuso to:
- generate content that is unlawful, harmful, threatening, abusive, or hateful;
- attempt to extract the system prompt or manipulate the AI into bypassing its guidelines;
- submit personal data belonging to third parties;
- generate content that infringes any third party's intellectual property rights.
Free users receive a limited number of McMuso conversations per day. The daily music quiz is available free of charge to all users. We reserve the right to change usage limits at any time.
We may suspend or remove access to McMuso at any time without notice if We reasonably believe these terms have been breached.
20. MUSOPLAY+ SUBSCRIPTION AND PAID CONTENT
Musoplay+ is an optional auto-renewing subscription that unlocks unlimited McMuso conversations. The Memory Week Pass is an optional one-time purchase that unlocks Musoplay Memory for seven days from the time of purchase. All Paid Content is sold and processed by Apple through the App Store.
Paid options and pricing:
- Musoplay+ Annual: billed at the price displayed at point of purchase, renewed every 12 months;
- Musoplay+ Monthly: billed at the price displayed at point of purchase, renewed every month;
- Memory Week Pass: one-time purchase at the price displayed at point of purchase, granting seven days of access to Musoplay Memory.
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
You can view, manage, or cancel your subscription at any time through Settings > Apple ID > Subscriptions on your iOS device. If you cancel, you will retain access to Musoplay+ benefits until the end of your current billing period.
Apple, not Us, sends subscription-related emails such as receipts, upcoming renewal reminders, and price-change notices. You can manage these notification preferences through your Apple ID account settings.
Refunds are handled by Apple. To request a refund, please use https://reportaproblem.apple.com. If you experience a genuine issue with your purchase, please also contact Us at claire@claireandoscar.com and we will do our best to help.
We reserve the right to change pricing. Any price change for an existing auto-renewing subscription will take effect at the start of your next billing period following notice from Apple, and you may cancel before the new price takes effect if you do not agree.
By subscribing, you acknowledge and agree that your subscription will automatically renew until you cancel it through your Apple ID account settings.
All three Musoplay games (Original, DOT, and Create & Share) remain free regardless of subscription status.
21. LAW AND JURISDICTION
These Terms shall be governed by the laws of Scotland with the courts of Scotland having exclusive jurisdiction.
If you are a UK/EU consumer, you benefit from any mandatory provisions of the law in your country of residence.
